- PROMOTION DESCRIPTION. The IKEA Brooklyn "Get There Giveaway" Mobile Instant Win Game and Sweepstakes ("Game") is a Short Message Service ("SMS") and Internet based Instant Win Game and Sweepstakes which begins at 12:01:00 AM (ET) on 5/28/08 and ends at 11:59:59 PM (ET) on 6/22/08 ("Promotion Period"). By participating in the Game, each entrant agrees to comply with and abide by these official rules and the decisions of IKEA North America Services, LLC, 420 Alan Wood Road, Conshohocken, PA 19428 ("Sponsor"), which shall be final and binding in all respects.
- ELIGIBILITY. Open to legal residents of the States of New York, New Jersey and Connecticut who are 13 years of age or older at time of entry. Employees of IKEA North America Services, LLC, its respective parent company, affiliates, subsidiaries, partners, advertising and promotion agencies (collectively, "Promotion Entities") and their immediate family members and/or those living in the same household of each are not eligible to participate. All federal, state and local laws and regulations apply. Void outside of NY, NJ, CT and where otherwise prohibited.
- HOW TO PLAY THE GAME. There are two (2) ways to play the Instant Win Game and enter the Sweepstakes:
a) VIA TEXT MESSAGE. Play the Instant Win Game by finding hidden boxes in the "Get There" map located at http://info.ikea-usa.com/Brooklyn/game.aspx and then submitting an SMS via text message with the secret codes to 30364 (the "Short Code") from your cellular phone. Only winners will be notified. If you are an instant winner, you will be provided instructions on how to claim your prize via text message. Limit five (5) instant win game plays per person for the Promotion Period, regardless of method of play. Additionally, you may receive several text messages in response to your original submission, including a message confirming your entry, legal disclaimers and options to receive future promotional messages from any of the Promotion Entities. Carrier specific charges for text messages may apply, depending on your individual cellular pricing plan, in accordance with your cellular customer agreement. SMS may not be available for all service providers or for all handsets. Cellular phone carrier’s instructions for text messaging may be different. Check your phone capabilities for specific instructions. The text message entry portion of this Game works with most U.S. cellular carriers and requires a two-way text messaging enabled cellular phone. Sponsor makes no guarantee that any particular wireless service provider will participate.
Check with your service provider for details. By texting the code, the entrant grants permission to the Sponsor to notify them via a return text message and must agree to accept all applicable charges associated therewith. Wireless service providers may charge entrants for each text message, including any error message that is sent and received in connection with the Game, based on the applicable wireless service pricing plan. You are responsible for all applicable fees and taxes associated with placing an SMS Entry. Sponsor in its sole discretion may add or delete a cellular carrier at any time, without notice. Proof of text messaging the Short Code is not considered proof of delivery to or receipt by Sponsor of such game play.
b) VIA INTERNET (for non-Mobile entrants). Play the Instant Win Game online by finding the hidden boxes in the "Get There" map located at http://info.ikea-usa.com/Brooklyn/game.aspx and then entering the secret codes into the form located at http://www.cellit.net/clientwork/ikea/bame.php. Follow the online instructions to play the Instant Win Game. Only winners will be notified. If you are an instant winner, you will be provided instructions online on how to claim your prize. Limit five (5) instant win game plays per person for the Promotion Period, regardless of method of play.
c) GRAND PRIZE SWEEPSTAKES ENTRY. Entrants will be automatically entered into the Sweepstakes upon the successful completion of an Instant Win Game entry, regardless of method of entry. Limit five (5) Sweepstakes entries per person for the Promotion Period, regardless of method of entry.
No automated entry devices, bots and/or other programs and/or software are permitted for Game entry. All entries become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind, whether mechanical, human or electronic. Only fully completed entries are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
Sponsor is not responsible for any change of mailing address, email address, and/or telephone number of entrants. In the event of a dispute, any SMS entries and/or Internet entries will be deemed to have been submitted by the Authorized Account Holder of the wireless phone used to enter (SMS entry) or the authorized account holder of the email address (Internet entry) submitted at the time of entry, provided that person meets all eligibility requirements set forth in these Official Rules. "Authorized Account Holder" means the natural person who is assigned to a wireless phone number or email address by a wireless service provider, Internet access provider, online service provider, or other organization that is responsible for assigning cellular phone numbers or e-mail addresses for the cellular phone numbers or domain associated with the submitted accounts. Entrants may not enter more than the once per day with a cellular phone number or e-mail address. Any entrant who attempts to enter the Game more than once per day using multiple cellular phone numbers or e-mail addresses or under multiple identities will be disqualified from participation in the Game and all entries from that individual will be considered void.
- INSTANT WIN GAME AND SWEEPSTAKES - WINNER DETERMINATION. Winners will be randomly determined based on time of day of game entry. Sweepstakes - Winner will be selected in a random drawing on or about 6/24/08 from among all eligible entries received from all methods combined by Sponsor or its designee, the judges in this Sweepstakes, whose decisions are final and binding. Winners will be notified by phone, mail and/or email at Sponsor’s discretion.
- PRIZES/APPROXIMATE RETAIL VALUE (ARV)/ODDS. Sweepstakes Prize: One (1) Grand Prize – Prize includes: A $1,000 IKEA Gift Card (winner only); a $500 IKEA Gift Card (for each guest – max. of 4); a $200 American Express Gift Card (winner only) – ARV $3,200. Instant Win Game Prizes: Fifteen (15) First Prizes- A $500 IKEA Gift Card. Twenty-five (25) Second Prizes – A $100 IKEA Gift Card. One Hundred (100) Third Prizes – A $50 IKEA Gift Card. Total ARV of all prizes is $20,200. Gift cards are subject to the terms and conditions associated with their use. Odds of winning in the Instant Win Game depend on total number of eligible entries received from all methods combined and the order in which they are received. Odds of winning the Sweepstakes prize depend on total number of eligible entries received from all methods combined. Unclaimed prizes will not be awarded. All applicable federal, state, and local taxes on prizes are the sole responsibility of the prize winners. Limit one (1) Instant Win Game Prize and Sweepstakes Prize per person. Grand Prize winner will receive a 1099 tax form for the approximate retail value of the prize.
- GENERAL. Potential Grand Prize winner (if a minor, his/her parent or legal guardian) will be required to sign and return a notarized Affidavit of Eligibility/Liability Release and, where permitted by law, Publicity Release within ten (10) days after first notification attempt. Guests of Grand Prize winner (if winner is a minor, one of winner’s guests must be his/her parent or legal guardian) will be required to sign and return a notarized Liability/Publicity Release prior to awarding of prize. Any prize won by an entrant who is deemed to be a minor will be awarded to the winner’s parent/legal guardian on behalf of the winner. If prize notification or prize is returned as non-deliverable, prize may be forfeited and an alternate winner may be selected. No correspondence will be acknowledged. No cash equivalents, substitutions or transfer of prize permitted. Promotion Entities will have no liability whatsoever for any injuries, losses or damages of any kind resulting from acceptance, possession, use and/or misuse of any prize or participation in the Game. Acceptance of a prize shall be construed as and signify the winner's agreement and consent that Sponsor may use the winner's name, voice, likeness and/or prize information, without limitation, for promotional purposes without further consideration, review, approval or payment, unless prohibited by law. Sponsor is not responsible for any typographical or other error in the printing of the offer or in administration of the Game.
Any attempted form of entry into the Game, other than the entry methods stated, is prohibited. No automatic, programmed, robotic or similar means of entry are permitted. Sponsor, its affiliates, partners and promotion and advertising agencies are not responsible for lost, late, mutilated or illegible entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware, software, electronic, network, telephone or other communications malfunctions, errors or failures of any kind, errors in transmission, lost or unavailable network connections, telephone connections, wireless phone connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture or entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed transmissions which may limit or restrict an entrant’s ability to play the Game, including any injury or damage to participant’s or any other person’s phone/computer, or other matter relating to or resulting from participating in this Game or downloading any materials in the Game. If for any reason the SMS and/or Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Game, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the SMS and/or Internet portion(s) of the Game and select the winner(s) by random drawing from among all eligible entries received from all methods combined up to the point of the action taken by the Sponsor. Caution: Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent of the law.
- SECOND CHANCE DRAWING - A second chance drawing will be held on or about 6/25/08 to award any unclaimed/unawarded Instant Win Game prizes. Entrants will be automatically entered into the Second Chance drawing upon successfully entering the Sweepstakes. Only non-winning entrants will be automatically entered into the Second Chance Drawing. All unclaimed and/or unawarded Instant Win Game prizes (if any are available) will be awarded. Odds of winning in the Second Chance drawing depend upon the total number of unclaimed/unawarded Instant Win Game prizes available and the total number of Second Chance entries received.
